Criminal proceedings can begin with an arrest, a summons as a suspect (investigado) or a complaint, and the first decisions can matter. Antonio Galiano Legal is a law firm in the Sant Andreu district of Barcelona with a 24-hour criminal law service: we assist people who have been arrested, defend people under investigation and represent victims and complainants at every stage of the proceedings.

    • 24-hour assistance after arrest, at the police station and at the duty court
    • Defence in fast-track trials, minor offences and abbreviated proceedings
    • Complaints, private criminal actions and private prosecution for victims, at any stage of the proceedings

The rights of a person under arrest

The Spanish Constitution and the Criminal Procedure Act give every person under arrest a set of rights, which the police must inform them of in writing and in a language they understand:

    • To remain silent. Not to make a statement, not to answer particular questions and not to incriminate themselves.
    • A lawyer of their choice. To appoint a lawyer and speak to them in private before making a statement.
    • To notify someone. To have a relative or a person of their choice informed of the arrest and, for foreign nationals, their consulate.
    • An interpreter. Free of charge, if they do not speak or understand Spanish.
    • A doctor. To be examined by the forensic doctor.
    • A time limit. Detention may last no longer than strictly necessary and, at most, 72 hours before the person is brought before a judge.

    How criminal proceedings move forward

After the complaint or the arrest, the court investigates the facts during the pre-trial investigation stage (instrucción). If it finds sufficient evidence, the case goes to trial; if not, it may be dismissed. Some offences are dealt with as fast-track trials, within a few days, and minor offences are tried without a prior investigation. Each stage involves decisions, and we explain them to you before they are taken.

If you are a victim or want to report an offence

The victim of an offence can take part in criminal proceedings as a private prosecutor (acusación particular), with a lawyer and a court representative (procurador), to propose investigative steps, support the prosecution and claim the compensation due. This can be done from the outset, with the complaint or private criminal action (querella), or by joining proceedings already under way within the time limits set by law. We review what stage your case has reached and what steps are still available.

    Frequently asked questions

Can I speak to my relative who has been arrested?
While they are held at the police station, the family normally cannot communicate with them. You can, however, contact a lawyer to go and assist them; the appointment is subject to confirmation by the person arrested. The lawyer speaks to them in private and, with their consent, tells the family what can be passed on.
How long can an arrest last?
Detention may last no longer than strictly necessary for the police enquiries and, in any event, no more than 72 hours. Within that time the person must be released or brought before the duty court, which will decide on their situation.
Do I have to make a statement?
No. You have the right not to make a statement, not to answer particular questions and not to incriminate yourself. Whether to make a statement, and when, is a decision best taken after speaking to your lawyer and learning what you are accused of.
    What is a fast-track trial?
It is a procedure for certain offences punishable by up to five years in prison, where the circumstances set out in the law are met and the investigation can be carried out immediately. The case is investigated at the duty court and the trial can take place within a few days, so the defence has to be prepared quickly.
    Do you also represent victims?
Yes. We file the complaint or private criminal action and act as private prosecutor, which makes it possible to propose investigative steps, take part in statements and at trial, and claim compensation for the harm suffered. It is also possible to join proceedings already under way, within the legal time limits.
    How much are your fees?
They depend on the nature of the matter and the stage of the proceedings. Before we start, we give you a written quote, which can be set by stages: investigation, trial and, where applicable, appeals. In an urgent assistance after arrest, we tell you the cost as soon as possible.
