Fraud lawyer in Barcelona

Have you been the victim of fraud, misappropriation or theft, or are you the person accused or under investigation? Antonio Galiano Legal, a law firm in the Sant Andreu district of Barcelona, acts in both situations: we act as private prosecutor on behalf of the victim and take on the defence of the person accused or under investigation.

    • Complaints and private prosecution for victims
    • Defence of people under investigation for property crimes
    • Recovering losses within the criminal proceedings themselves

    What these offences are

    • Fraud (estafa). Deceiving someone into doing something that causes them financial loss, such as a transfer or a payment. If the amount defrauded does not exceed 400 euros, it is a minor offence; if it does, the basic penalty is six months to three years in prison.
    • Misappropriation. Keeping money or property received with the obligation to return it or to use it for a specific purpose.
    • Theft and robbery. Taking other people's property. It is theft if there is no force, violence or intimidation, and a minor offence if the value does not exceed 400 euros. It is robbery if there is.
    • Online fraud. Fake purchases, impersonation of banks or companies and other online scams usually amount to fraud.

    If you are the victim

    • Act quickly. Keep the messages, emails, receipts and statements. If there is an unauthorised charge on your account, tell your bank immediately: payment services rules may require the bank to refund it.
    • Report it. We help you file a well-organised complaint with the necessary documents.
    • Prosecute. As a private prosecutor you can take part in the proceedings, request investigative steps and claim restitution and the compensation due.

    If you are under investigation

    • Do not make a statement without advice. You have the right not to make a statement and to do so after speaking to your lawyer.
    • We review the accusation. We examine what you are accused of and whether the prosecution has what the law requires.
    • We explain the options. For example, making good the harm caused can reduce the sentence. We explain what consequences each decision may have.

    What we handle

    • Fraud and online scams
    • Misappropriation
    • Theft and robbery
    • Minor property offences
    • Private prosecution for victims
    • Defence in abbreviated proceedings and fast-track trials
    • Claims for civil liability arising from the offence

    How we work

We put the documents in order. In these matters, the paperwork is almost everything: dates, payments, messages. We organise it from day one.

We act quickly. Some deadlines, such as those for notifying the bank, are short.

We speak plainly. We tell you what it is realistic to expect from the proceedings, without promises.

    Frequently asked questions

Will I get my money back?
It depends on whether the person responsible is identified and on their solvency. In criminal proceedings, restitution of what was obtained and compensation for the loss can be claimed; in the case of an unauthorised charge, the bank may be obliged to refund it. No lawyer can guarantee recovery.
Is it fraud or simply non-payment?
Not every non-payment is fraud. Fraud requires prior deception that leads the victim to make the payment or hand over the property. If what happened is a later failure to pay, without any initial deception, the usual route is a civil debt claim, which we can also handle.
I have been summoned as a suspect for fraud. What should I do?
Do not go to make a statement without first speaking to a lawyer. You have the right to know what you are accused of, not to make a statement and to do so after speaking to your lawyer. Call us with the summons to hand so that we can prepare the statement.
How long do I have to report it?
It depends on the penalty for the offence: minor offences become time-barred after one year and basic fraud after five years. Even so, it is best to report it as soon as possible, because digital and banking evidence can be lost and some time limits for claiming from the bank are short.
    How much are your fees?
They depend on the matter and the stage of the proceedings. Before we start, we give you a fixed written quote.
